TLC MEMBER REWARDS PROGRAMME
TERMS & CONDITIONS
- In these Terms and Conditions:
Hairhouse Warehouse means The Hairhouse Warehouse Pty Ltd ABN 65 079 509 738 and includes where appropriate Hairhouse Warehouse’s employees, agents, contractors, officers, franchisees and related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)).
Card means the Hairhouse Warehouse TLC card issued in accordance with these Terms and Conditions.
Cardholder means a person who has applied for a Card and whose application has been accepted by Hairhouse Warehouse.
Programme means the TLC Member Rewards Programme run by Hairhouse Warehouse.
- By applying for the Card the applicant agrees to be bound by these Terms and Conditions and any variations to them; agrees to participate in the Programme; and agrees to receive information and promotions via e-mail, and SMS/MMS (where such information has been provided by the Cardholder).
- To apply for a Card and become a Cardholder, the person must:
- visit a Hairhouse Warehouse store and register their name, email address and post code; then
- activate their card online by visiting www.hairhousewarehouse.com.au.
- Only individuals can apply for a Card. Trusts, partnerships, joint ventures, associations, corporations or any other body corporate cannot apply. A Cardholder may hold 1 Card only.
- Hairhouse Warehouse may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application for a Card.
- Cardholder rights are determined by Hairhouse Warehouse from time to time and may include discounts for products purchased at participating Hairhouse Warehouse stores.
- The rights of a Cardholder are non-transferable and not redeemable for cash.
- Discounts only apply to the Cardholder noted on the Card and may not be used in conjunction or combination with any other offer or promotion including the Hairhouse Warehouse 10%, 12% and 15% discount cards. Cardholder discounts are not available on goods at “sale” or “special” prices.
- Hairhouse Warehouse may, in its absolute discretion and without giving reasons for its decision, at any time substitute advertised discounts for any other item of a comparable value or amend or withdraw any promotions.
- Hairhouse Warehouse shall not be liable in any way if benefits or promotions are unavailable as a result of a technical malfunction, operator fault, errors resulting from computer hardware or software errors or failure.
- All discounts for Cardholders for purchases at Hairhouse Warehouse stores are subject to availability.
- A Cardholder must produce their Card if seeking the benefit of any discount or other benefit offered to Cardholders, or upon request by Hairhouse Warehouse.
- Hairhouse Warehouse does not warrant in any way that the discounts or benefits for Cardholders will be available at any particular time or times or in any particular place.
- Cardholder rights are valid until terminated or cancelled by Hairhouse Warehouse (in its absolute discretion) or until the Cardholder notifies Hairhouse Warehouse customer service on 9234 2200 that he or she wishes to terminate their Card. If a Card is terminated the Cardholder must return the Card by hand to a Hairhouse Warehouse store or by mail to Hairhouse Warehouse Pty Ltd, PO Box 4449, Doncaster Heights, Victoria 3109.
- Hairhouse Warehouse is not responsible for stolen or lost Cards or Cards that are used fraudulently. The Cardholder must report a stolen or lost Card to Hairhouse Warehouse immediately. The Cardholder’s existing Card will be cancelled and a new Card issued.
- To the greatest extent permitted by law, Hairhouse Warehouse gives no warranty and shall have no liability in respect of goods or services provided to Cardholders or as to the accuracy of any description or information about such goods or services, even though Hairhouse Warehouse may have notified the Cardholder of those goods or services.
- Hairhouse Warehouse makes no warranty or representation as to the quality, suitability or merchantability of any goods or services offered as prizes.
- Cardholders indemnify Hairhouse Warehouse for and against any loss or claim suffered or incurred by Hairhouse Warehouse arising from or in connection with a breach of these Terms and Conditions by a Cardholder.
- Hairhouse Warehouse holds and uses a Cardholder’s personal information in accordance with Hairhouse Warehouse’s privacy policy (a copy of which can be obtained at www.hairhouse warehouse.com.au) and these Terms and Conditions.
- A Cardholder can access his or her personal information held by Hairhouse Warehouse by contacting Hairhouse Warehouse's Privacy Officer at Hairhouse Warehouse Pty Ltd, PO Box 4449, Doncaster Heights, Victoria 3109. Telephone (03) 9234 2200. Using our Contact Us form and selecting Privacy Officer in the subject field.
- The purpose for Hairhouse Warehouse collecting personal information is for a Cardholder to participate in the Programme. For the purposes of operating the Programme, Hairhouse Warehouse may provide personal information to third parties, such as mailing houses and data entry providers. If a person does not provide Hairhouse Warehouse with information required in the application form, he or she may not be eligible to become a Cardholder or participate in the Programme.
- Hairhouse Warehouse reserves the right to:
- suspend or terminate the Card at any time and without prior notice; and
- vary these Terms and Conditions at any time for any reason and without notice to Cardholders.
- For the avoidance of doubt, these Terms and Conditions supersede and replace any and all previous Terms and Conditions specifically governing the Programme.
